The final deadline to file UK trade mark and design applications and claim back the original filing date from corresponding EUTM and RCD applications expires on 30 September 2021.

By way of reminder, the UK IPO automatically cloned all EUTM / RCD registrations at 11pm on 31 December 2020 to ensure continued protection in the UK. However, it did not clone the pending EUTM / RCD applications and therefore it is the responsibility of brand owners to 're-file' these in the UK within the nine month transition period if protection is required. These re-filed applications will be identical to the corresponding EUTM / RCD applications, including the key earlier filing date, but will undergo the UK IPO's standard examination process. 

This transition period is shortly coming to an end and therefore urgent action is required if you have not yet re-filed your EUTM / RCD applications in the UK. Wedlake Bell's Trade Mark and Design practice is well placed to assist you with such filings.
