The Government is consulting on proposed changes to the Mental Capacity Act 2005 Code of Practice, which includes guidance on the new Liberty Protection Safeguards system. This is the first change to the Code of Practice since it was introduced in 2007. There have been many legal changes over that time and this is a welcome update. It includes new guidance on lasting powers of attorney including where there are joint appointments, updates on cancelling an LPA and importantly updated guidance on gifts by attorneys. The consultation period runs to 7 July 2022.
